Welcome to Speechord. These Terms of Service ("Terms") form a binding legal agreement between you ("you," "your," or "User") and the operator of the Speechord service ("Speechord," "the Service," "Operator," "we," "us," or "our"). They govern your access to and use of the Speechord communication platform at https://speechord.com, together with any associated applications, desktop or mobile clients, APIs, and related services (collectively, the "Service").
By creating an account, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.
Speechord is a self-hosted, real-time communication platform that lets users create and join communities, exchange text messages, share content, and participate in voice and video conversations.
Free expression is the founding principle of this Service. We believe in the open exchange of ideas. We do not restrict, remove, or penalize lawful speech merely because it is controversial, offensive, distasteful, unpopular, blasphemous, politically incorrect, or objectionable to others or to us. You may share lawful opinions and content here that may be prohibited or removed on other platforms.
This commitment is bounded by law, not by taste:
We do not actively monitor, pre-screen, edit, or curate User Content, and we are under no obligation to do so. We generally act on illegal content when it is reported to us or otherwise comes to our attention.
You must be at least 16 years old to create an account or use the Service. By using the Service, you represent and warrant that:
The Service is not directed to children under 16, and we do not knowingly collect personal information from anyone under 16. If we learn that we have collected personal information from a child under 16, we will delete it. If you are between 16 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf.
This list is intentionally narrow. Consistent with our free-expression policy, we prohibit only content and conduct that is illegal or that directly threatens the integrity, safety, or lawful operation of the Service. You may not use the Service to create, post, store, link to, request, or facilitate any of the following:
(a) Child sexual abuse material (CSAM) and child exploitation. Zero tolerance. Any sexual content involving minors, or any content that sexualizes minors, in any form. We report all such material and associated account information to the National Center for Missing & Exploited Children (NCMEC) and/or to law enforcement as required by law (including 18 U.S.C. § 2258A), and we preserve related data as legally required.
(b) Unlawful threats and incitement. True threats of violence against identifiable persons, and incitement or solicitation directed to producing imminent lawless action and likely to produce such action.
(c) Terrorism and violent extremism. Providing material support to, or soliciting participation in, terrorism or designated terrorist organizations, as prohibited by law.
(d) Sexual exploitation, trafficking, and non-consensual imagery. Human trafficking or sexual servitude; and the distribution of non-consensual intimate imagery ("revenge porn") or intimate images shared without the depicted person's consent.
(e) Illegal goods, services, and transactions. Selling, buying, advertising, or facilitating transactions in items or services that are illegal under applicable law (for example: controlled substances, stolen goods or data, unlawful firearms or weapons transactions, counterfeit goods, or fraudulent financial instruments).
(f) Fraud and deception. Phishing, scams, fraud, or impersonation undertaken to deceive others for unlawful gain.
(g) Intellectual-property infringement. Content that infringes another party's copyright, trademark, or other intellectual-property rights. See Section 7.
(h) Malware and attacks. Distributing malware or malicious code; gaining or attempting to gain unauthorized access to systems, accounts, or data; or conducting denial-of-service, abusive scraping, or other attacks against the Service, its infrastructure, or its users.
(i) Unlawful invasions of privacy. Publishing another person's private or identifying information in violation of applicable law, or for the purpose of harassment, intimidation, or to incite others to harass or harm ("doxxing," where unlawful).
(j) Platform abuse. Spam, mass unsolicited messaging, automated abuse, artificially inflating activity, circumventing security measures or rate limits, or evading enforcement actions or bans.
(k) Other unlawful activity. Any other use of the Service that violates applicable U.S. federal or state law, or that uses the Service to plan, commit, or further illegal activity.
For the avoidance of doubt: lawful speech that does not fall within one of the categories above is permitted, even if some users (or we) find it offensive or objectionable. Where a category above references illegality, it is to be read consistently with applicable law, including legal protections for speech.
We respect intellectual-property rights and respond to valid notices under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
If you encounter content you believe is illegal or violates Section 6, report it to the contact address in Section 20 with: the location of the content (link and/or IDs), a description of the issue, and your contact information. We review reports and act at our discretion as described in Section 9. Good-faith reporting is encouraged; knowingly false or abusive reports may result in action against your account.
In addition to Section 6, you agree to: comply with all applicable laws when using the Service; not interfere with or disrupt the integrity, performance, or security of the Service; not attempt to access areas, systems, or data you are not authorized to access; and not use the Service to violate the rights of others. You are responsible for any equipment, software, and internet access needed to use the Service.
Your use of the Service is also governed by our Privacy Policy (available at https://speechord.com/privacy), which explains what information we collect and how we handle it. By using the Service, you consent to the data practices described there.
The Service relies on third-party infrastructure, including hosting, network and DDoS-protection providers, and real-time media services. Your use of the Service may also be subject to those providers' terms. We are not responsible for, and do not endorse, third-party services, websites, or content that may be referenced or linked through the Service, and your dealings with them are solely between you and the third party.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Service will be uninterrupted, timely, secure, error-free, or that content will be preserved or backed up. Speechord is a self-hosted, best-effort service. We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. To the maximum extent permitted by law, you use the Service at your own risk.
To the maximum extent permitted by applicable law:
You agree to indemnify, defend, and hold harmless the Operator from and against any claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your User Content; your use of the Service; your violation of these Terms; or your violation of any applicable law or the rights of any third party.
We may update these Terms from time to time. We will indicate material changes by updating the "Last Updated" date above and, where practical, by providing notice within the Service. Changes are effective when posted. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws principles. Before filing any formal claim, you agree to first contact us at the address in Section 20 and attempt in good faith to resolve the dispute informally. For any dispute not resolved informally, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Florida, and you waive any objection to such jurisdiction or venue. Nothing in this section prevents either party from seeking injunctive or equitable relief.
